As of September 2024, California enacted new emergency regulations regarding hemp and CBD products. These laws prohibit the sale of any hemp or CBD product that contains detectable levels of THC or other intoxicating cannabinoids per serving. Additionally, consumers must be at least 21 years old to purchase hemp products, and packages are limited to five servings each. Enforcement is being overseen by various state agencies, including the Department of Public Health and the Department of Cannabis Control.
These measures were met with pushback from industry stakeholders, leading to a lawsuit that challenges the regulations on the grounds that the state failed to demonstrate an urgent need for such laws. The emergency regulations are set to expire in March 2025, and lawmakers are working on permanent legislation to further regulate the hemp industry in the state.
