Arrested After Police Watch Her Dump A Cooler Full of Cans



Bodycam Footage -On April 14, 2024, at approximately 12:30 PM, Officers of the Florida Fish and Wildlife Conservation Commission were on marked vessel patrol in Martin County, FL. They were patrolling in Manatee Pocket near Sandspit Park when they observed a personal watercraft heading towards St. Lucie Inlet. The vessel was operating at high speed, creating a large wake, and was not maintaining a slow speed as required in a manatee zone. During the observation, the vessel’s cooler, which was in two pieces, spilled over 20 beers into the water.
The officers pursued the vessel and informed the occupants that they were littering. There were three females on the jet ski, including the operator. The operator had difficulty managing the jet ski and was later identified as a suspect. The females struggled to retrieve the discarded items. The operator’s lifejacket was improperly secured, and there were empty alcoholic beverage containers and other floating debris on the vessel.
Due to the operator’s confusion, difficulty following instructions, and pinpoint pupils, the officers decided to transfer her to their vessel to conduct field sobriety tasks to ensure she was fit to operate the vessel. On the officers’ vessel, she was seated at the front and instructed on the tasks. She was repeatedly told to keep her hands at her sides. During the task instructions, she revealed that she wore contacts, took birth control, and used CBD on that date.
Field Sobriety Tests:
• Horizontal Gaze Nystagmus: The operator exhibited a lack of smooth pursuit in both eyes, nystagmus at maximum deviation in the right eye, and a lack of convergence, indicating possible THC impairment. Total clues: 3 plus lack of convergence.
• Finger to Nose: The operator struggled to follow instructions, hesitated, searched multiple times, and missed the tip of her nose. Total clues: 17.
• Palm Pat: The operator could not follow instructions, did not count as directed, rolled her hands, and needed to be instructed to increase speed. Total clues: 4.
• Hand Coordination: The operator started at the wrong time and had improper touches. Total clues: 3.
• Eye Convergence: The operator repeatedly demonstrated a lack of convergence in her eyes.
Arrest:
Based on the observations and the operator’s inability to complete the tasks adequately, she was arrested for operating a vessel with impaired normal faculties. She was handcuffed, with the handcuffs double-locked, and transported to Sailfish Marina by vessel and then to Martin County Jail by marked patrol vessel.
During the transport, the operator expressed nausea and indicated she might vomit. She disclosed that she was prescribed Prozac, birth control, and medical marijuana, which she used via a vape pen. She claimed to have taken double her prescribed dosage of marijuana THC at approximately 9:00 AM, and the officers observed her operating the vessel at 12:21 PM, just 3 hours and 21 minutes later. Her actions, including operating a vessel after taking a higher dose of THC than prescribed and within a shorter time frame than recommended, were deemed reckless and dangerous.
At the Martin County Jail, the operator was read her implied consent rights and initially refused to provide a breath sample. She also refused to provide a urine sample. She was read her Miranda warnings and agreed to answer some questions. The operator stated that it might have been beneficial for her to be stopped, as she was en route to consume more alcohol, suggesting that some events happen for a reason. While argumentative initially, she eventually calmed down and cooperated at the jail.
She was booked into Martin County Jail without incident and charged with:
• BUI (Boating Under the Influence) with impaired normal faculties
• Littering
• Failure to submit to breath and urine tests
• Manatee zone violation
• Personal watercraft lifejacket violation
