A bipartisan team of U.S. House lawmakers have filed a proposal that would mandate the Food and Drug Administration to draft standards for hemp-derived CBD-containing foods and drinks and authorize interstate trade.

The “CBD Product Safety and Standardization Act” seeks to assist in reducing a statutory loophole that hemp advocates have been urging the FDA to close.

Although the 2018 Farm Bill federally authorized hemp and its byproducts, there are presently no standards in line with best practices for the legal promotion of CBD-infused foods and drinks, regardless of the reality that goods are routinely commercially available throughout the nation.

As per the proposal’s language, the FDA would be obligated to draft regulations and hear public feedback on the quantity cap of hemp-derived CBD that might be put in a food or beverage product by serving, labeling and packaging standards, and “conditions of intended use.”
