Cannabis News: South Dakota Cannabis Update



Last year, South Dakota residents voted to approve ballot proposals to legalize both recreational and medical cannabis, and the state Supreme Court has now officially invalidated it, saying that the legislation breached the “single subject” criteria for amendments to the state constitution.

Now, backers of recreational cannabis must return with a proposal for the next election that solves the court’s issues unless state lawmakers separately adopt the legislation.

The court decided that, among others it found problematic, one provision distinguishing hemp from cannabis mixed hemp and medical cannabis measures with wider legalization and thus unfairly pushed individuals that supported either one of the limited reforms to also vote in favor of adult-use cannabis.
