Germany’s More Lenient Law for Drivers Using Cannabis
Background and Legislative Changes
In 2024, Germany made significant adjustments to its laws concerning cannabis use, particularly for drivers. This comes in the wake of the partial legalization of recreational cannabis earlier in the year. As of August 2024, the Bundestag, Germany’s federal parliament, increased the legal THC limit for drivers from 1 nanogram per milliliter to 3.5 nanograms per milliliter of blood.
Key Details of the New RegulationsTHC Threshold:The new threshold of 3.5 nanograms per milliliter of blood is now the legal limit above which drivers are considered impaired. This represents a substantial increase from the previous limit of 1 nanogram. This level was recommended by a panel of experts from the Transport Ministry, who equated it with the impairment risk posed by 20 milligrams of alcohol per 100 milliliters of blood, which is also legally permissible in Germany.
