Listen: Supreme Court weighs case on emergency abortion care

The fight over abortion returns to the Supreme Court on Wednesday, this time with a debate over the clash between emergency treatments in the hospital and state bans following the end of Roe v. Wade.

At issue: the court is deciding whether Idaho’s strict abortion restrictions conflict with a federal law requiring hospitals provide emergency care, including abortion if needed to protect the mother’s health.

The Biden administration is challenging Idaho’s ban, arguing doctors must follow the federal law. State officials say the Supreme Court turned the abortion issue over to states to decide.

The high-profile case – the second-to-last the court is hearing this term – comes one month after the justices considered a challenge to a commonly used abortion drug and as the abortion issue continues to remake electoral politics, including in Arizona where a near-total ban from 1864 is back in play
