MMJ Biopharma Cultivation’s lawsuit against the U.S. Department of Justice and the Drug Enforcement Administration (DEA) raises important constitutional and procedural questions regarding the agency’s administrative proceedings. The company alleges that the DEA’s process, particularly in appointing administrative law judges (ALJs), violates constitutional principles.
The crux of MMJ’s argument lies in the assertion that DEA ALJs, like those in other federal agencies, should be appointed by either the president or the attorney general, in accordance with the Constitution’s appointments clause. MMJ contends that the current selection process for DEA ALJs does not meet these requirements, as they are chosen by the DEA administrator, not by presidential appointment.
The lawsuit draws parallels to the 2018 Supreme Court case Lucia v. SEC, which found the Securities and Exchange Commission’s (SEC) ALJ appointment process unconstitutional. MMJ argues that the DEA’s process mirrors the SEC’s in this regard and should therefore be subject to the same scrutiny.
